Terms of Service

Please read these terms carefully before using The Cuddle Pro platform. By booking a session or registering as a Cuddle Pro, you agree to be bound by these terms.

Section 01

Acceptance of Terms

By accessing or using The Cuddle Pro platform — including our website, mobile application, or any related services (collectively, the "Platform") — you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you may not use the Platform. We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

Plain English: By using The Cuddle Pro, you're agreeing to these rules. We'll let you know when they change, but it's your responsibility to stay up to date.

Section 02

Platform Overview

The Cuddle Pro is a marketplace platform that connects clients seeking professional therapeutic touch services with independent, certified practitioners ("Cuddle Pros"). The Cuddle Pro does not itself provide therapeutic touch services.

All sessions facilitated through the Platform are provided by independent Cuddle Pros who are not employees, agents, or contractors of The Cuddle Pro. The Cuddle Pro's role is limited to:

  • Hosting and operating the booking platform
  • Processing payments on behalf of Cuddle Pros
  • Setting and enforcing platform standards and certifications
  • Providing customer support for platform-related issues

The Cuddle Pro does not provide medical, psychological, or clinical therapeutic services, and nothing on this Platform should be construed as such.

Section 03

Eligibility

To use The Cuddle Pro, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using our services under applicable law
  • Provide accurate and truthful registration information

To register as a Cuddle Pro, you must additionally:

  • Complete The Cuddle Pro's approved certification training programme
  • Pass a background check conducted by our third-party screening partner
  • Agree to the Cuddle Pro Code of Ethics
  • Maintain a valid government-issued ID on file

Important: Creating an account on behalf of another person, or providing false information during registration, will result in immediate account termination and may expose you to legal liability.

Section 04

Client Responsibilities

As a client using the Platform to book sessions, you agree to:

  • Communicate honestly about your needs, health conditions, and comfort levels prior to and during sessions
  • Respect boundaries established by your Cuddle Pro at all times — including physical, emotional, and conversational limits
  • Arrive or be present at the agreed location on time and in a suitable condition to receive services
  • Not request or attempt to engage in any sexual, romantic, or otherwise inappropriate conduct during or in connection with a session
  • Pay the agreed session rate plus any applicable fees directly to your Cuddle Pro as arranged
  • Provide accurate location and contact information at the time of booking

Violation of any of the above may result in session termination without refund, account suspension, and/or reporting to relevant authorities.

Section 05

Cuddle Pro Responsibilities

As a Cuddle Pro registered on the Platform, you agree to:

  • Maintain your certification and comply with all training and renewal requirements set by The Cuddle Pro
  • Conduct all sessions in a professional, platonic, and boundary-respecting manner consistent with your training
  • Not engage in any sexual conduct, romantic behaviour, or anything outside the scope of professional therapeutic touch
  • Keep your availability, profile, and pricing accurate and up to date on the Platform
  • Respond to session requests within the timeframe specified at booking (typically 12 hours)
  • Report any incidents or boundary violations by clients to The Cuddle Pro promptly
  • Maintain your own liability insurance — The Cuddle Pro does not provide insurance coverage for Cuddle Pros

You acknowledge that you are operating as an independent contractor and are responsible for your own taxes, insurance, and compliance with applicable laws.

Section 06

Bookings & Payments

All bookings are made through The Cuddle Pro Platform. The booking process works as follows:

  1. Client selects a Cuddle Pro, session type, date, and time
  2. The full session amount is authorized on the client's payment method at booking
  3. The Cuddle Pro has 12 hours to accept or decline the request
  4. If accepted, the payment is captured and the session is confirmed
  5. If declined or expired, the authorization is released — no charge is made
  6. The Cuddle Pro receives 85% of the session fee — The Cuddle Pro platform retains a 15% service fee

Payments are processed securely via Square. The Cuddle Pro does not store your full card details. By providing payment information, you authorize The Cuddle Pro to charge your payment method for applicable fees.

Note: Your card is authorized at booking but only charged once your Cuddle Pro accepts. If declined, the authorization is released automatically and you are never charged.

Section 07

Cancellations & Refunds

Client cancellations:

  • Cancellations made more than 24 hours before a confirmed session: full refund
  • Cancellations made within 24 hours of a confirmed session: payment is non-refundable
  • No-shows: payment is non-refundable and may result in account review

Cuddle Pro cancellations:

  • If a Cuddle Pro cancels a confirmed session, the client will receive a full refund
  • Repeated cancellations by a Cuddle Pro may result in account suspension

Disputed sessions: If you believe a session did not meet platform standards or a serious incident occurred, contact us at support@thecuddlepro.com within 48 hours. We will review the case and issue refunds at our discretion where appropriate.

Section 08

Code of Conduct

The Cuddle Pro is built on safety, respect, and professionalism. All users — clients and Cuddle Pros alike — must abide by the following:

  • No sexual conduct. Any sexual behaviour, requests, or innuendo is strictly prohibited and will result in immediate removal from the platform and potential legal action.
  • Respect boundaries. All boundaries communicated before or during a session must be honoured without question.
  • No harassment. Harassment of any kind — verbal, physical, or digital — is prohibited.
  • No discrimination. Users may not refuse services or engage in harmful behaviour based on race, gender, sexuality, religion, disability, or any other protected characteristic.
  • Honest communication. Do not misrepresent yourself, your credentials, your intentions, or your health status.
  • Sobriety. All parties must be sober during sessions. Attending a session under the influence of alcohol or drugs is grounds for immediate termination of the session and account review.
Section 09

Safety & Reporting

Your safety is our highest priority. If at any point during a session you feel unsafe, you have the right to end the session immediately.

To report an incident:

  • Email us at support@thecuddlepro.com within 48 hours of the incident
  • Include your session ID, a description of what occurred, and any relevant communications
  • We will respond within 24 hours and take appropriate action

The Cuddle Pro reserves the right to suspend or permanently ban any user who violates our safety standards. In cases of illegal activity, we will cooperate fully with law enforcement.

Emergency: If you are in immediate danger, call 911 (or your local emergency services) first. Then contact us.

Section 10

Privacy & Data

Your privacy matters deeply to us. Our full Privacy Policy explains in detail how we collect, use, store, and protect your personal information. Key points:

  • We collect only the data necessary to operate the Platform and facilitate bookings
  • We do not sell your personal data to third parties
  • Payment data is handled exclusively by Square and is never stored on our servers
  • Session details are kept confidential and are only accessed by The Cuddle Pro staff when necessary for safety or dispute resolution
  • You may request deletion of your account and associated data at any time by contacting support@thecuddlepro.com
Section 11

Intellectual Property

All content on The Cuddle Pro Platform — including text, logos, graphics, design, and software — is owned by The Cuddle Pro or its licensors and is protected by copyright and trademark law.

You may not reproduce, distribute, modify, or create derivative works from any The Cuddle Pro content without our express written permission.

By uploading content to the Platform (such as profile photos or bios), you grant The Cuddle Pro a non-exclusive, royalty-free licence to use, display, and reproduce that content in connection with operating and promoting the Platform.

Section 12

Disclaimers

The Cuddle Pro provides the Platform on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

  • The quality, safety, or suitability of any individual Cuddle Pro
  • The therapeutic outcomes of any session
  • The uninterrupted or error-free operation of the Platform
  • The accuracy of any Cuddle Pro profile information

Important: The Cuddle Pro is not a mental health or medical service provider. Sessions are not a substitute for professional therapy, counselling, or medical treatment. If you are experiencing a mental health crisis, please contact a licensed professional or crisis line.

Section 13

Limitation of Liability

To the maximum extent permitted by applicable law, The Cuddle Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any session facilitated through it.

The Cuddle Pro's total liability to you for any claims arising under these Terms shall not exceed the amount of fees paid by you to The Cuddle Pro in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you in full.

Section 14

Termination

The Cuddle Pro reserves the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms or pose a risk to the safety of other users.

You may close your account at any time by contacting support@thecuddlepro.com. Upon termination:

  • Any pending bookings will be cancelled and payments refunded where applicable
  • Your profile will be removed from public search
  • We may retain certain data as required by law or for legitimate business purposes
